This Privacy Policy has been established for all use of the Mohamed SI AHMED and Diwan Consulting LLC-FZ websites (hereinafter referred to as "the Site"), namely: www.diwan-consulting.com. This Privacy Policy applies to any legal or natural person, whether legally capable or not, hereinafter referred to as "the User". Compliance with these provisions is required of any person visiting the Site and not solely upon the creation of a personal account or the validation of an order. Failure to comply with the provisions of this Privacy Policy may expose its author to legal proceedings, noting that the liability of the legal representative may be engaged in the absence of compliance by minors or any person who is not legally capable. The Site, for its part, undertakes to comply with all provisions of the Privacy Policy and to take all necessary steps to ensure the full protection of Users' personal data. The company specialises in marketing and business consulting, personal development coaching and the dissemination of information related to the development of professional activities. The site aims to provide internet users (meaning any natural or legal person who visits or uses the site, hereinafter "users" or "you") with information to discover the company's activities and services (training sessions, seminars, consulting, etc.) or its news (events, publications, testimonials, etc.). The site may also offer features enabling users to contact the company (contact requests, etc.) or to subscribe to the newsletter. The company may also sell its products and services through the site and may, under certain conditions, offer users the option to create a personal account. When browsing or interacting with the site or the company, the latter may collect and process personal data concerning you, acting as data controller. Respectful of privacy, the company attaches great importance to the protection of your personal data. This policy aims to transparently set out the terms and characteristics of the data processing carried out by the company through or by means of the site.
1. Use of the Site: The Site, its content and services are intended to be accessible and fully functional with the latest versions of the following operating systems: Microsoft Windows, Android, Mac OS, Linux; and the following browsers: Internet Explorer, Google Chrome, Mozilla Firefox and Safari. In the event of malfunctions caused by an outdated operating system or browser, the User is invited to carry out updates. Every User agrees to use the Site strictly for personal purposes and to comply with all applicable legal and regulatory provisions, whether UAE, French or European, as well as the Site's General Terms and Conditions. The User acknowledges that the information provided to the Site is personal and does not in any way constitute information belonging to a third party who has not previously consented to the use and communication of their personal data.
2. Collection of Personal Data: Mohamed SI AHMED and Diwan Consulting LLC-FZ undertakes to collect and process data in a lawful, fair and transparent manner in accordance with Regulation No. 2016/679, known as the General Data Protection Regulation (GDPR), and applicable French provisions. A User's information is collected when they browse the Site, provide their email address and all requested personal information, place an order, or contact the Site by any means. The personal data collected and stored on the Site includes all information entered on the Site, whether for the purpose of receiving invitations and proposals by email, for the creation of a personal account, or for the purpose of placing an order. This may include civil status, identity and identification data (such as name, first name, email address, date of birth, profession, phone number, address, etc.), data relating to professional life (CV, education, professional training, profession, duration, etc.), and connection data (IP addresses, event logs, etc.). The Site also has access to the User's connection and browsing data (IP address, operating system, etc.). The User's banking details are neither communicated to nor retained by the Site; they are held solely by the integrated payment solution, an external professional independent of Mohamed SI AHMED and Diwan Consulting LLC-FZ.
3. Protection of Personal Data: In accordance with Law No. 78-17 of 6 January 1978, every User has the right to query, access, rectify, delete, be forgotten, limit, port and object to their personal data by contacting the Site by post at the following address: Mohamed SI AHMED and Diwan Consulting LLC-FZ, Meydan Grandstand, 6th floor, Meydan Road, Nad Al Sheba, Dubai, UAE, or by email at: office@diwan-consulting.com. Personal information collected on the Site is retained for the entire duration of account activation. After a period of three years without account activation, the User will receive an email inviting them to confirm their wish to keep their account active. Failing that, personal data will be archived, with the exception of connection information. Archived data is retained for a period of 24 months. After this period, retained information will be used solely for statistical purposes and will be anonymised. In any event, the User may request the deletion of their account, upon which their data will be deleted. The Site uses information security techniques to protect Users' data through access control procedures, cryptographic mechanisms and firewalls, to prevent unauthorised access and ensure data confidentiality. However, no security measure is infallible and the Site cannot guarantee total and absolute security to the User.
4. Purposes and Legal Bases for Data Processing: All processing of personal data must be based on a legal basis set out in Articles 6 and 9.2 of the GDPR in order to be lawful. Personal data may be processed for the purposes of managing and developing registration on the Site, sending information about offers and emails, and responding to requests to exercise rights of access, modification, cancellation and objection, as well as questions and complaints. The data collected is used for the purpose of processing orders and managing them properly in order to achieve the intended objective, namely the creation of a micro-enterprise and the preparation of standard documents offered on the Site. The legal bases for which they are intended to be used and retained are the Site's legitimate interests (proper functioning of the Site, order processing, improvement of services and offers, and user support), the performance of its obligations, and compliance with the Site's legal obligations.
5. Data Transmission: The User's data is not intended to be communicated for any purpose other than the proper delivery of the service or to comply with legal and public order obligations. Mohamed SI AHMED and Diwan Consulting LLC-FZ undertakes to ensure that any subcontractor provides sufficient contractual guarantees regarding the implementation of appropriate technical and organisational measures, so that processing meets the requirements of the European data protection regulation. Mohamed SI AHMED and Diwan Consulting LLC-FZ may engage one or more subcontractors to carry out specific processing activities, which will be subject to the conditions of this Policy. No subcontractor will be authorised to itself engage a subcontractor without the prior written authorisation of Mohamed SI AHMED and Diwan Consulting LLC-FZ. The Site may therefore communicate the User's data to: the payment solution; external service providers of Mohamed SI AHMED and Diwan Consulting LLC-FZ responsible for ensuring the proper functioning of the services offered to Users and Clients; external service providers responsible for data storage on a secure server; and public bodies and authorities in the context of legal proceedings, disputes, requests from public authorities or for national security purposes, in accordance with applicable legal and regulatory public order provisions. The Site applies French and European legislation regarding partner prospecting, under which any transfer of a User's personal data to partners is systematically subject to obtaining the User's consent. Finally, Mohamed SI AHMED and Diwan Consulting LLC-FZ may communicate information relating to Users for the purposes of sector and market analysis, demographic profiling, promotional and advertising purposes, and other commercial purposes. The information communicated will be anonymous and non-nominative.
6. Hyperlinks: In the event that the Site contains hyperlinks to websites published and/or managed by third parties, the Site is in no way responsible. Since no control is exercised over external resources, the User acknowledges that the Site assumes no responsibility for their availability and cannot be held liable for their content or any advertising or promotional offers contained in these links. The User is invited to notify the Site of any hyperlink on the Site that leads to content contrary to the law or public morals.
7. Use of Cookies: For its proper functioning, the Site may use cookies. These are files sent to the browser by a web server in order to record the User's activities during their browsing session. Cookies are in no way intended to access, collect or use personal information. Deleting cookies from the site may make browsing more difficult, as the User may not be able to access certain features of the Site. Each time the User connects to the site, a temporary cookie will be created containing no personal data, and this cookie will be deleted as soon as the User closes their browser.
